Terms of Service

1. Acceptance of Terms

By accessing or using Captain's knowledge search API service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Service

Captain provides a knowledge search API that enables users to index, search, and retrieve information from various data sources including documents, images, and videos. The Service includes access to our API, SDKs, documentation, and related tools.

3. Account Registration

To use the Service, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be responsible for all activities under your account

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Transmit malicious code or interfere with the Service
  • Attempt to gain unauthorized access to our systems
  • Use the Service for any illegal or harmful purpose
  • Resell or redistribute the Service without authorization

5. Your Data

You retain all rights to the data you upload to the Service ("Your Data"). By using the Service, you grant us a limited license to process Your Data solely for the purpose of providing the Service. We will not use Your Data to train our models or share it with third parties except as necessary to provide the Service.

6. Fees and Payment

Some features of the Service require payment. You agree to pay all applicable fees as described on our pricing page. Fees are non-refundable except as required by law or as explicitly stated in these Terms. We may change our fees with 30 days' notice.

7. Service Level Agreement

For paid plans, we commit to the uptime guarantees specified in your service agreement. If we fail to meet these commitments, you may be eligible for service credits as described in our SLA documentation.

8. Intellectual Property

The Service, including all software, documentation, and content, is owned by Captain and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. YOU USE THE SERVICE AT YOUR OWN RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAPTAIN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Termination

Either party may terminate this agreement at any time. Upon termination, your right to use the Service will immediately cease. We may suspend or terminate your access if you violate these Terms. Provisions that by their nature should survive termination will remain in effect.

12. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes through the Service or by email. Your continued use of the Service after such notice constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts located in San Francisco County, California.
